1. Acceptance of Terms
By accessing or using Set the Tune (“Service”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These Terms apply to all users, including school administrators, operations managers, and any other individuals who access the Service.
2. Description of Service
Set the Tune is a scheduling software platform for music schools and lesson-based businesses. The Service allows users to manage teachers, students, assignments, availability, and scheduling seasons. The Service is provided on a subscription basis.
3. Accounts and Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized use of your account.
- Each school account is isolated — you may not access data belonging to another school.
4. Subscriptions and Payment
- Subscription fees are billed in advance on a monthly basis via Stripe.
- All fees are non-refundable except as required by law.
- You authorize us to charge your payment method on a recurring basis.
- We may change pricing with 30 days' notice. Continued use after the change constitutes acceptance.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Upload malicious code, viruses, or any harmful data.
- Scrape, reverse engineer, or reproduce the Service without written permission.
- Use the Service in a way that disrupts or degrades its performance for other users.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of all data you upload to the Service. By using the Service, you grant us a limited license to store and process your data solely to provide the Service.
7. Student Data
The Service may be used to store personally identifiable information about students, including names, addresses, and lesson details. You are solely responsible for obtaining any necessary consents from students and their families, and for complying with applicable privacy laws including FERPA and COPPA where applicable.
8. Intellectual Property
The Service, including all software, design, content, and trademarks, is the property of Set the Tune and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service as described herein.
9. Termination
Either party may terminate your account at any time. Upon termination, your access to the Service will cease. We may suspend or terminate accounts for violation of these Terms. You may export your data at any time before termination.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Use of the Service is at your own risk.
11. Limitation of Liability
To the fullest extent permitted by law, Set the Tune shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Diego County, California.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice in the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
